CBDT Extends ITR Filing Deadline in J&K and Ladakh

There is a sign of relief for the tax assessees residing in the state of Jammu & Kashmir. The due date for the Income Tax Return filing has now been extended for the taxpayers of J&K. 

The Central Board of Direct Taxes (CBDT) has recently notified that the Deadline for Income Tax Return filing and Tax Audit Report (TAR) in the case of tax assessees in Jammu & Kashmir (J&K) and Ladakh, has now been extended from 31st October 2019 to 30th November 2019.

Furthermore, Income Tax Returns filed by the non-corporate or individual tax assessees who are not subject to the tax audit and were supposed to file ITR till the due date of 31st August 2019 but have filed ITR after 31st Aug till 31st October 2019, shall be deemed to have filed within the due date.

1. Why the ITR filing Due date has been extended in J&K?

The ITR filing Due date has been extended due to technical glitches resulting from disturbances in the Wi-Fi facility in some areas of Jammu & Kashmir and Ladakh. 

As a result, the CBDT has further extended the deadline for ITR filing and Tax Audit Reports (TAR) u/s 44AB of the Income Tax Act 1961, to 30th November 2019. This is applicable to all the categories of taxpayers assessees of the Union Territory of Jammu & Kashmir and the Union Territory of Ladakh.


2. What about the individual taxpayers? 

The non-corporate or individual tax assessees who are not subject to the tax audit were required to file their ITRs till the due date of 31st August 2019. However, those who have filed their Income Tax Returns after 31st Aug till 31st October 2019, shall now be deemed to have filed their ITR within the due date only.

In this regard, it is important to note that the taxpayers who have filed ITR beyond the due date of 31st August 2019, have also paid the applicable late fee of ₹5,000/-

Now, the question arises that if their Income Tax Returns are deemed to have filed within the due date,

"Will the late paid by them be waived off or refunded?"

The government is yet to give clarification in this regard.
