Know how much Penalty is to be charged in case of late filing of GSTR-1 and 3B

It is beyond any doubt that the newly implemented Goods and Service Tax (GST) law has simplified the taxation system for the government as well as the taxpayers to an unprecedented extent.  It has undoubtedly made the taxation system more convenient and foolproof than ever before by facilitating curbing of tax evasion and plugging of revenue leakage. One of the most recurrent doubts that are common among the tax assesses is regarding the penalty for late filing of GST returns. 

Before going into those details, it is important to know about the significance of two major types of Goods and Service Tax returns, GSTR-1 and 3B.

Return

Purpose of Return

Due Date of filing return

GSTR-1

Outward Supplies of every month are required  to be reported like

  • Sale
  • Stock transfer to other branches
  • Export
  • Any other movement of goods

 

10th of every next Month/Quarter*

 

Exception: For the month of April, return requires to be file on or before 10th May

GSTR-3B

                    

Summarized return to settle the GST tax liability.

20th of every next month.

* In GSTR-1, there are two broad categories of taxpayers:

  • Those having an annual aggregate turnover less than ₹ 1.5 crores, need to file GSTR-1 on the quarterly basis.
  • Those with an annual aggregate turnover of more than ₹ 1.5 crores, need to file GSTR-1 on monthly basis.

The Penalty for non-filing of GST

The penalty for non-filing of GSTR-1 till due date has been temporarily discontinued as of now.

However, for non-filing of GST Return 3B, the penalty is as follows:

  • In case of nil transaction, a penalty of ₹ 20 per day will be chargeable till such delay continues.
  • In case even a single transaction has been done, a penalty of ₹ 50 per day will be chargeable till such delay continues.

It is evident that the amount of tax penalty goes on accumulating with successive deferments. This causes much apprehension among taxpayers.
