The FSC applies to a wide range of exportable goods, including things you might use every day, like medical devices, food items, cosmetics, and even biological products.
It is important to have a Free Sale Certificate for major two reasons which are as follows:
#1. Builds trust with the importing country: Shows product is legal and sold freely in the exporting country.
#2. Smooths import process: Avoids customs delays by proving product isn't restricted.
Both Manufacturer Exporter and Merchant Exporters requires a Free Sale Certificate.
# Establishes Manufacturer Legitimacy: A Free Sale Certificate acts as official verification that the exporting company is a licensed and recognized business.
# Ensures Product Compliance: It confirms the product is legally sold and meets safety standards within the exporting country.
# Guarantees Quality Manufacturing: The certificate verifies the product's adherence to Good Manufacturing Practice (GMP) guidelines, signifying high-quality production processes.
# Facilitates Import Clearance (in some cases): In certain countries, a Free Sale Certificate can expedite the import process, particularly for medical devices (e.g., India).
The issuing authority for a Free Sale Certificate depends on the product you will export:
#1. Medical Devices and Instruments: For these products, a Free Sale Certificate is typically issued by a national regulatory body responsible for overseeing medical products. The specific agency name will vary depending on the country.
#2. Other Products: In India, for products other than medical devices and instruments, the Directorate General of Foreign Trade (DGFT) acts as the issuing authority for Free Sale Certificates. Applications are submitted through their regional authorities or website.
To get a Free Sale Certificate in India, your product needs to meet two main requirements:
#1. Not a Medicine or Cosmetic: It can't be something regulated by the Drugs and Cosmetics Act, so not a medicine or cosmetic. To export a medicine or cosmetic, you will need CDSCO Registration or US FDA Certification . But it can still be used in hospitals for medical reasons. For example a special medical equipment, not pills or ointments.
#2. Legally Acceptable to Export: The Indian government doesn’t have any restrictions on shipping this item out of the country. It basically needs to be a product that's freely allowed for export.

Your user profile must be linked to a valid Import Export Code (IEC).
A valid Digital Signature Certificate (DSC) must be registered in the system.
A valid RCMC (Registration cum Membership Certificate) linked to your IEC.
You cannot apply if your IEC is suspended, cancelled, or in DEL status.
Items not restricted or prohibited for export.
Items not covered under the Drugs and Cosmetics Act, 1940, and used in hospitals etc. for medical purposes.

Filter by selecting "Certificate Management" and "Apply for Free Sale and Commerce Certificate" in the dropdown menus.

Click on "Action" and then select "Withdraw".

Click on "Action" and then select "View Approved Licenses" and "View Letter".
Go to "My Dashboard" on DGFT’s website and then "Submitted Applications".
Filter by selecting "Certificate Management" and "Apply for Free Sale and Commerce Certificate" in the dropdown menus.
Check the status under the "File Status" column.
Upon successful payment, you will see an acknowledgement message.
You can also verify by following the steps above and clicking on "Action" and then "Payment Details".
Go to "My Dashboard" on DGFT’s website and then "Submitted Applications" (filter as above).
Click on "Action" and then select "Respond Deficiency".
View the deficiency letter and respond accordingly.
