How to protect mobile app and website | Website copyright - mobile app copyright | how to copyright app and website |

We sometimes hear that someone has stolen ideas from others and have worked on it. Then the first party claims against it and the second party has to pay for it. Do you know why this happens? What is the procedure of it? This is due to Copyright. In this article, we will know that what is Copyright and how to protect your mobile app and website under Copyright.

Copyright is a form of Intellectual Property Rights (IPR) which is given to the original work so that no one can copy it. It is provided by the laws of United States. The works which are protected by copyrights include photographs, literature work, movies, software, paintings etc. Copyright gives special rights to the author of the work to publish or edit the work and no other can work on the theme without taking permission from the person. It is important to know that if an employee produces any such work for the company for which he/she works then the real author has no right on the work and the work belongs to the company because he has been already paid for the work.

If you have started your business or is looking to start your business then you must have an online presence. For this you require a website or an app. But before making your own website or Mobile you must have a knowledge that how to protect these under Copyright Act. As the world is getting digitalized more and more and if you are not able to secure your app and website then this can be a danger to you as one can steal them.  We are sharing some ideas by which you can protect your mobile app and websites. Here we go.

Start building your own app If you have an awesome idea to build a new app then you should not waste your time in thinking. You should implement it. Once you get the code, no one can steal your idea.

Non Disclosure Agreement (NDA) If you don’t have any person who has a technical background then you can appoint a freelancer to develop an app. Building trust in a third party and then sharing idea can be a major issue. For this, you need to assure that the person does not share your idea with anyone. For this, you can ask him to sign Non-Disclosure Agreement. NDA is a legal agreement between two parties in which they cannot share the ideas or information to any third party. If the two fail to do this, then one can claim on other.

Apply for a trademark of your App logo and nameThere a number of apps available on play store which are the copy of another app. So, you need to apply for a trademark for your App logo and name in order to protect it. You must know that you can easily claim for copyright if you have copyright ownership and proof that others have tried or copied the idea of your app.

Apply for Patent In some countries like UK and countries of European Union, you cannot get a patent for software. So, there you can be in touch with the patent authorities to find whether your software can get patent or not but if you are India, you can easily apply for it.

Action against the developers who copy your workIf you find someone working on your idea then you can take strict action and stop them from doing it. But you must know that whether the person has copied your whole idea or partial idea and then has added some additional features to it. If the person has added some additional features then his/her app becomes different from yours.

Non Competent AgreementNon-Competent Agreement is basically used to prevent the technical individuals who are working on your project to work on a similar idea of your competitor.

Identity Check If you are looking to build your app or website which is highly confidential then you must check the identity of the person (freelancer/employee) before taking him to your project. You must check his/her past record so that you can assure that the person is not fraud.

Documentation Proper documentation is very important before you take anyone to your project. Make a list of work which you have assigned and keep everything in written work. If the person denies committing later on to the work which you have assigned then you will have the upper hand on him and you can prove yourself in the court. Take print outs and maintain the file.

App UploadIf you have done with your work of completing app or website then you need to be more careful. You must upload the app/website to your own account.

Hope the concept of Copyright is all clear to you and you have to come know about how to protect your website or mobile app. You must be conscious and keep an eye on your competitors about their steps after you launch a new idea in the market. You should keep on checking whether the idea has been stolen by others or not. This will help you to be updated and keep away your competitors. All the best!
